City Correct to Avoid Appeal on Park

As the trustee for Beacon Hill Park, the City of Victoria was wise to seek direction from the court on whether the terms of the trust permitted them to allow a multi-day folk festival in the park, says UVic law professor Sandra McCallum. But a ruling against this specific event doesn't make the park off-limits to non-profit events with corporate sponsorship, she adds. "If I was the city, I wouldn't appeal," says McCallum, who teaches property law and trusts. "It was wise of the city to seek direction on the festival which would have involved several commercial outlets and taken over large areas of the park for several days. But to interpret that court ruling as a ban on all events in the park is incorrect."   Media Contacts:
